Latvian tax residence is a facts test, not a card
Latvia can treat you as resident because your declared residence is here or because you spend at least 183 days here. But a second country may still claim you. A clean relocation connects dates, home, family, work, income and treaty evidence.
Three legal gateways to resident status
Section 14 of Latvia’s Law on Taxes and Duties uses alternatives, not a cumulative six-month checklist.
Declared residence in Latvia
A natural person is treated as resident when their declared place of residence is in Latvia. This domestic rule matters from the date and factual context of the declaration.
183 days in a 12-month period
Residence also arises when the person stays in Latvia for 183 days or more in any 12-month period beginning or ending in a tax year. It is not limited to one calendar-year count.
Latvian government employment abroad
A Latvian citizen employed abroad by the Latvian government is also resident under the statutory test. This specialist rule is usually irrelevant to an incoming founder.
Keep immigration, company and tax files separate
Residence permit or visa
It supports your right to stay in Latvia under its conditions. By itself it neither completes the domestic tax test nor eliminates a claim by another country.
Latvian SIA
It is a separate corporate taxpayer. Owning or directing the SIA does not automatically move your personal tax residence, and personal residence does not erase company-management questions.
Tax residence evidence
Address registration, day count, home, family, work, economic ties, filings and a residence certificate create the personal file used with tax authorities and treaty relief.
Domestic residence is the first test, not always the last
Only Latvia claims you
Build the Latvian start date, registrations, income map and filing calendar. The tax treatment of salary, dividends, business income, capital and foreign income then follows the applicable Latvian rules.
Latvia and another state both claim you
Check whether a tax treaty applies. Its tie-breaker normally works through the permanent home, centre of vital interests, habitual abode, nationality and competent-authority process in the treaty’s order.
You keep a home and business abroad
These facts do not automatically block Latvian residence, but they can support the other country’s claim. A declared Latvian address is not a licence to live and manage everything elsewhere.
You hold a Latvian permit but live in Portugal
Immigration status and tax status can diverge. Portugal, Latvia or both may apply domestic tests; the treaty then resolves dual residence if its conditions are met.

Do not confuse the SIA’s deferred tax with personal taxation
Personal income
VID publishes progressive personal income-tax rates of 25.5% and 33%, with an additional 3% above the published annual threshold. The exact result depends on the income category and reliefs.
Capital gains
The current personal rate on capital gains is 25.5%, including relevant gains on property, shares, financial instruments, intellectual property and cryptoassets, subject to exemptions and calculation rules.
Retained SIA profit
A Latvian company generally pays no corporate income tax on retained profit and applies the 20/80 model when profit is distributed or deemed distributed. That company rule is not a personal tax-residence shortcut.
Foreign-country exposure
Exit tax, CFC, foreign-company reporting, departure returns and social security belong to the country concerned. They need local-country validation alongside the Latvian plan.
Personal tax-residence questions
